The online shopping website www.signetdart.com was set up by Magali Atlan, the website operator.
The present terms and conditions are concluded on one hand by Magali Atlan, registered under the Dijon Trade Register number SCR 337 740 998 and located in Bévy 21220, 29 rue du Perthuis, and on the other hand by persons wishing to make a purchase via the www.signetdart.com website, hereinafter referred to as the « customer ».
These terms and conditions concern exclusively natural persons, not traders. The two parties agree that their relation will be governed exclusively by this contract, excluding any conditions previously available on this website. If a condition were to be lacking, it would be considered to be governed by the rules generally practiced in the field of online selling companies with headquarters in France. The present terms and conditions of sale will be validated by the user by one single click when ordering.
These terms and conditions aim to define the terms of sale between Magali Atlan and the customer, from ordering via payment to delivery. They regulate all steps necessary to execute the order and enable order tracking and monitoring.
The products covered in these terms and conditions of sale concern the products presented on the www.signetdart.com website. The photographs of the products are not contractual.
The contractual information will be included in the confirmation process via e-mail no later than at the time of the delivery or, failing that, at the address specified by the customer in the purchase order. Any order sent to our company is irrevocable except for application of deadline retraction as described below.
Only residents of the member states of the European Union, DOM (Overseas departments) and Switzerland can order.
The prices are quoted in Euros and are valid until the date of dispatching of the order to the customer. They do not include shipping which is billed as a supplement and listed on the order page. The price appears all taxes included variating according to the place of delivery. When applicable, the VAT takes into account the rate in effect on the day of the order. Any change in the VAT rate will be automatically passed on to the prices in the online store. The payment of the full price must be carried out when ordering. Payments can never be considered as a deposit or installment.
Transfert of property - Transfert of risks
The transfer of property of Magali Atlan to the customer will only be made after the full payment by the latter regardless of the date of delivery of the products. The risk of loss and deterioration of the products of Magali Atlan is provided by the latter until the delivery of the products.
The deadline of delivery and manufacturing appearing on the site is indicative. In no case our responsibility may be engaged in the event of delay.
Terms of delivery
The products are delivered to the address specified by the customer in the purchase order. The customer is required to verify the condition of the packaging of goods at the time of delivery and report any damage to the carrier in the delivery documents at the time of delivery and to Magali Atlan within 3 business days. As for shipping, we work mainly with the French Post “La Poste”. As soon as we proceed to the shipment, the customer will be immediately informed about it by email. To ensure the order we can opt for a “Declared Value” expedition. The services of “La Poste” are reliable. However, as in any expedition, it may happen that there is a delay in delivery or that the product goes astray. In case of delay in the delivery regarding the deadline given in the email on expedition, the customer is asked to report this delay to us by phone or email. We will contact “La Poste” and ask for an investigation to start. Such investigation can last up to 21 days starting with the date of announcement. If the product is found during this period, it will be re-routed immediately to the customer's address (most cases). If, on the other hand, the product is not found after the 21 days of investigation, “La Poste” considers the package to be lost. It is only then that we can send the customer a replacement at our expense. If the products are not available any more at that time, we will refund the exact value of the products in question. We disclaim any responsibility for longer deliveries due to the carrier, particularly in cases involving loss of products or strike.
Delivery issues due to the carrier
All anomalies concerning the delivery (damage, missing products compared to the slip, damaged package, broken products) have to be denoted at the time of delivery in the delivery documents as objections in handwriting with the signature of the customer. At the same time the customer has to confirm this anomaly to the carrier by registered mail with the delivery receipt stating those claims. The customer has to send a copy of the letter by fax or by mail to: Magali Atlan.
- The customer has to inform Magali Atlan on any claim of delivery error or non-conformity of the products in kind or in quality compared to the indications on the order form on the day of delivery or the following business day at the latest. Any claim made after this period will be rejected.
- The claim can be communicated to Magali Atlan by calling +33 6 35 90 51 01 Monday to Friday form 9AM to 12 and 2 PM to 5.30 PM.
- Any claim not made according to the rules defined above and within the deadlines will not be taken into account and exempts Magali Atlan from responsibility towards the customer.
- Upon receipt of the complaint, an exchange number is assigned to the concerned product(s) and the customer receives this number by email, fax or phone.
- A product can be exchanged only after the attribution of the exchange number and its communication to the customer as explained above.
- In case of exchange or error of delivery, any product to be exchanged or refunded must be returned by registered mail to Magali Atlan as a whole and in its original packaging to the following address:

To be accepted, any return of a product must be reported to the Customer Service of Magali Atlan. The shipping costs are borne by Magali Atlan only in case of error of delivery. If a returned product does not correspond to the original description done by the customer in the return documents, the costs are borne by the customer.
In accordance with the article 4 of Decree No 78-464 of 24th of March 1978, the provisions described above cannot deprive the customer of the legal guarantee that the seller is required to ensure against all consequences of hidden defects of the product.
Right of retractation
The customer has legal right to retract and return at their costs a product that does not suit them within 14 business days. This deadline runs starting the day of delivery of the ordered products. If this deadline expires on a Saturday, Sunday or a bank holiday, it is postponed to the first following business day. According to the law, professional customers (traders and legal persons) are not entitled to this right of retraction. Any return must be previously reported to the Customer Service of Magali Atlan : by phone at +33 6 35 90 51 01 from Monday to Friday from 9 AM to 12 and from 2 PM to 5.30 PM. Only products returned as a whole in their original packaging, intact and in perfect condition to be able to be resold can be accepted. Any damaged product or in a damaged original packaging cannot be refunded or exchanged. As far as personalized products (such as rings) are concerned, the right of retraction is in this case excluded in accordance with article L121-20-2 of the Consumer Code. This right of retraction is carried out without penalty except for the costs of return. In case of exercise of the right of retraction, the customer has the right to choose either a refund of payments or an exchange of the product. In case of the exchange, the re-shipment is at the expense of the customer. In case of retraction, Magali Atlan will make every effort to refund the customer within 30 days. The user will be then refunded by cheque.
In all stages of access to the website, ordering process, delivery or post services, Magali Atlan is bound only by obligation of means. Magali Atlan cannot be held responsible for all inconveniences and inherent damages in the use of Internet network, include service failure, external intrusions or presence of computer viruses, or any act classified as a force majeure in accordance to the jurisprudence.
The customer personal information is requested in order to treat their order and may be provided to Magali Atlan's contractual partners involved in the processing of the order(s). In accordance with the law of the 6th January 1978, the customer has the right to access and correct the personal data by mail to the address provided above.
Patent and tradmark indemnity
All articles of the www.signetdart.com website, whether visual or audible, including sub-technologies, are protected by copyright, trademarks or patents and are of Magali Atlan's exclusive property. Any user having their personal website and wishing to place a link referring directly to the www.signetdart.com website, has to ask Magali Atlan for authorization. In this case it is not an implicit agreement of affiliation. On the contrary, any link to www.signetdart.com website using the technique of framing or in-line linking is strictly prohibited. In all cases, any link, even tacitly authorized before, must be removed upon Magali Atlan's request.
In the event that any clause of this contract is null and void by a change in legislation, regulation or by a court decision, it does not in any way affect the validity and compliance of these terms and conditions.
These terms and conditions apply throughout the duration of online services offered by Magali Atlan.
The computerized records stored in computer systems of Magali Atlan and her partners for reasons of safety will be considered as evidence of communication, orders and payments between the two parties.
Filing of purchase orders and invoices is made in a reliable and sustainable manner to match a copy true and lasting in accordance with the Article 1348 of the Civil Code.
Law and powers
The present terms and conditions are subjected to the French law. The allocation of powers in a case of dispute and in absence of an agreement between the two parties is given to the competent courts, in spite of cases of multiple defendants and / or collateral appeal, even for emergency proceedings or conservatory measures by referee or by application.
